Welcome to Fartagram. These Terms of Service (“Terms”) govern your use of the Fartagram app and website. By using Fartagram, you agree to these Terms. If you don't agree, please don't use the Service.

Not Medical Advice

Fartagram is purely for entertainment. All content is for informational and entertainment purposes only. Nothing constitutes medical advice. If you have health concerns, consult a qualified healthcare professional.

1. Eligibility

To use Fartagram, you must:

• Be at least 13 years old
• Have parental permission if under 18
• Not be prohibited under applicable law
• Not have been previously banned

2. Your Account

When you create an account, you agree to:

• Provide accurate information
• Keep credentials secure
• Be responsible for all account activity
• Notify us of unauthorized access
• Not share, sell, or transfer your account

3. Your Content

Ownership

You own your content. Fartagram does not claim ownership of any audio, text, or images you create.

License to Fartagram

By posting, you grant us a limited, non-exclusive, royalty-free, worldwide license to:

• Host and store your content
• Process (format conversion, compression)
• Display to other users within the Service
• Distribute according to your privacy settings

This license exists only to operate the Service and ends when you delete your content or account.

4. Prohibited Content & Conduct

Harmful or Abusive

• Harassment: Bullying, intimidation, or targeted abuse
• Hate speech: Violence or hatred based on protected characteristics
• Threats: Credible threats of violence
• Doxxing: Sharing private info without consent

Illegal or Exploitative

• Illegal content: Content violating laws or promoting illegal activity
• Sexual exploitation: Non-consensual content or CSAM
• Self-harm: Promotion of suicide or self-injury

Deceptive or Disruptive

• Impersonation: Misleading identity representation
• IP infringement: Copyright or trademark violations
• Spam: Unsolicited bulk messages or fake engagement

5. Moderation & Enforcement

If we find violations, we may:

• Remove or restrict content
• Issue warnings
• Temporarily suspend your account
• Permanently terminate your account
• Report illegal activity to law enforcement

Actions may be taken without prior notice. Terminated users may not create new accounts.

6. Copyright & DMCA

We respect intellectual property. To file a DMCA notice, email contact@fartagram.com with subject “DMCA Takedown Request” including:

• Identification of the copyrighted work
• Location of the allegedly infringing content
• Your contact information
• Good faith belief statement
• Statement under penalty of perjury
• Your signature

Repeat infringers will have their accounts terminated.

7. Purchases & Digital Goods

We may offer premium features or virtual items. If so:

• Final sales: All purchases final except as required by law
• No real value: Virtual items have no monetary value
• License: Purchases grant a limited, non-transferable license
• App Store: Purchases through Apple are subject to Apple's terms

8. Disclaimers

Please read carefully

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, including merchantability, fitness for purpose, accuracy, uninterrupted operation, or security.

9. Limitation of Liability

To the maximum extent permitted by law, Fartagram shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the greater of $100 USD or the amount you paid us in the past 12 months.

10. Governing Law & Disputes

These Terms are governed by the laws of California, USA. Disputes shall be resolved exclusively in the state or federal courts of San Francisco County, California. You consent to personal jurisdiction in those courts.
